REALNETWORKS, INC. ("SPONSOR") IS OFFERING THIS SKILL CONTEST ("CONTEST"). NO PURCHASE IS NECESSARY TO ENTER OR WIN.
- The Contest is open to legal residents of the 50 United States and District of Columbia (D.C.) who are professional or amateur developers or designers who may wish to use Rhapsody Web Services ("RWS"), and are 18 years of age or older as of the date of entry. Void outside the 50 United States and D.C. and where prohibited by law. Subject to all applicable federal, state and local laws and regulations. Employees of Sponsor, its affiliates, subsidiaries, advertising and promotional agencies, anyone contributing directly to the development of Rhapsody software and any other parties involved in any aspect with the creation, production, operation, execution, fulfillment or judging of this Contest, the officers, directors and agents of each of the foregoing entities, and members of the immediate families (defined for these purposes as parents, spouses, children, siblings and grandparents, and the respective spouses of any of the foregoing) or households (whether related or not) of any of the above, are NOT eligible to participate.
- The Contest starts on 7/13/06 at 12:00:00 AM Pacific Time (PT) and ends on 10/16/06 at 11:59.59 PM (PT) ("Contest Period"). You may enter as many "Mash-Ups" as you like during the Contest Period, provided each is different and is submitted separately along with all other required information. For the purposes of this Contest, a Mash-Up is an integrated application that combines a Rhapsody Web Service with content from one or more sources. Examples of Mash-Ups include RSS feeds, Rhaplinks, Smart URL's, Simple,js, data.xml, Rhapsody events, etc. Please see Section 5 below for more information about judging and criteria for winning.
- The entrants who submit the first one hundred and seventy five (175) eligible entries received will each be awarded an early entry gift of a special edition Rhapsody Web Services T-shirt. Approximate Retail Value: Twenty dollars ($20) each. Each eligible early entrant must allow approximately 8 weeks for his/her gift to be shipped following verification of eligibility of entrant and of the submitted Mash-Up/entry. All gifts will be awarded provided a sufficient number of qualifying entries are received and claimed properly in accordance with these Rules. If a qualifying entrant is 18 but deemed a minor in his/her state of residence, the gift will be awarded to his/her parent or legal guardian on the minor's behalf.
- Visit http://www.rhapsody.com/rws_contest and follow the instructions to submit your entry and the URL for your Mash-Up. All entries must be received by Sponsor by 11:59:59 PM (PT) on 10/16/06. All entrants must use one or more Rhapsody Web plus content from one or more sources, as defined above, to enter the Contest. Proof of submission of entry does not constitute proof of receipt by Sponsor. Entrants will receive an email confirmation for each entry received. However, all submissions are subject to verification of eligibility, and receipt of a confirmation email does not indicate that an entry has been deemed eligible. By submitting an entry, you warrant that you are authorized to submit the information on the Contest form and that the Contest form does not contain information considered by your place of business or any other third party to be confidential. Any entry not complying with the above entry requirements, or with any other provisions of these Official Rules, will be disqualified and will not be eligible for the Grand Prize or any early entry gift (if applicable).
- Entries will be judged on a monthly basis in July, August and September of 2006 to award the two (2) best monthly entrants with a Second Prize. The Grand Prize winner and First Prize winner will be selected between approximately 10/18/06 and 11/02/06 by a panel of qualified Web experts. All entries will be judged based on the following criteria: (1) usefulness (30%); (2) solution to an existing problem or need (20%); (3) novelty (30%); (4) number or depth of RWS services used (10%); and (5) quality, efficiency and simplicity of code (10%). By submitting a Mash-Up, you agree to give RealNetworks and the Judges all rights necessary or convenient, in the sole discretion of RealNetworks and/or the judges, to judge your Mash-Up in this Contest. You further agree to release and hold harmless RealNetworks and the Contest judges from and against any and all claims of copyright infringement or trade secret misappropriation or claims or actions of a similar nature arising from or in connection with such parties' exposure to your submissions, including the source code to your Mash-Up, so long as RealNetworks and the judges, as applicable, do not intentionally copy from your Mash-Up.
- All Mash-Ups must be original, must never have been published or won previous awards, must not infringe on third party rights, (including, without limitation any rights of copyright, trademark, patent, moral rights, unfair competition, defamation or privacy), and must not be obscene or indecent or unsuitable for publication in the sole opinion of the Sponsor. Though not owned by Sponsor, Sponsor's right to use the entry must not be restricted in any way. Modifying, enhancing or altering a third party's preexisting work does not qualify as entrant’s original creation and will subject the entrant to disqualification. Submission of an entry grants Sponsor and its agents the right to publish, use, adapt, edit and/or modify such entry in any way, in commerce and in any and all media worldwide, without time or other limitations, without compensation to the entrant, and without further notice to or approval of the entrant.
- Entries will not be returned or acknowledged, except as provide herein . By entering, all entrants accept and agree to be bound by these Official Rules and the decisions of the Sponsor or judges, which shall be final, binding and conclusive on all matters relating to this Contest. Subject to any exceptions herein as to rights to disseminate/use such information, Sponsor will treat all personal information in a manner consistent with Sponsor’s Privacy Policy which may be reviewed at Sponsor’s web site: www.real.com. Sponsor is not responsible for coding errors or any other errors in any submitted entry. Entries not complying with these Rules in any way are subject to disqualification at the sole discretion of the Sponsor. Only one (1) entrant's name may appear on an entry form. Prizes will be awarded only to the persons who submitted the winning entries, subject to the provisions of Rule 9, below.
- In addition to submitting your Mash-Up via the submissions process described above, you must host the source code for each of your submitted Mash-Ups during the Contest Period and for four (4) months thereafter, on a publicly accessible web site. You must submit that URL with your entry. Sponsor may, at Sponsor's sole discretion, choose to direct users to your URL to check out your Mash-Up(s). You can make the source code for your Mash-Ups available under the license of your choice. However, Sponsor encourages you to make the source code available under an open source license, such as the [GNU General Public License], or the Open Source Initiative open source license. These licenses provide very broad use rights, with few restrictions, and will enable a larger community to come together for learning, collaboration, and re-use based on your Mash-Ups.
- Entries will be deemed submitted by the authorized account holder of the e-mail address from which the entry is made. Sponsor reserves the right to void any entry made through any robotic, automatic, mechanical, programmed or similar entry method and to disqualify any individual using such a method. All entries are subject to verification. Sponsor and its agents are not responsible for: (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected or not received by Sponsor or its agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries or in or at the URL that hosts your source code or for destruction of or unauthorized access to, or alteration of, entries , (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants' or any person's computer and/or its contents, or causes beyond Sponsor's reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest, or (iv) any entries submitted in a manner that is not expressly allowed under these rules; all such entries will be disqualified. All incomplete or otherwise non-conforming entries will be disqualified. Sponsor and it agents are further not responsible for: (i) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in the Contest (including but not limited to the source codes and the URL's on which they are hosted) or by any technical or human error which may occur in the transmission, receipt or processing of the entries; or (ii) cheating or fraud by any participant. If, for any reason, the Contest is not capable of being executed as planned, including without limitation infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor or its agents that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right at its sole discretion to cancel the Contest without notice. If this Contest is terminated before the original end date, Sponsor will select the winner, based on the criteria stated herein, from among all eligible, non-suspect entries (if any) received as of the termination date/time. RealNetworks reserves the right to correct any typographical, printing, computer programming or operating errors within its reasonable control. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR OTHERWISE CORRUPT THE CONTEST OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
- One (1) Grand Prize will be awarded, consisting of the following: (a) two (2) roundtrip, coach air travel tickets to be used by the Winner ("Winner") and one (1) guest ("Guest") (who must be of the age of majority in his/her state of residence at the time of departure), from a major airport near the Winner's residence (as determined by Sponsor) to a single destination anywhere in the world selected by Winner (subject to Sponsor's approval and to maximum prize value, as noted below); (b) hotel accommodations (hotel selected by Sponsor) consisting of one (1) double occupancy room for six (6) nights; and (c) ground transportation in destination city between airport and the hotel; and, two (2) tickets to a concert. Maximum Retail Value: $5,000. One (1) First Prize is to be awarded, consisting of a Sonos® Digital Music System and a six (6) month subscription to Rhapsody To Go. Approximate Retail Value("ARV"): $1,380. Six (6) Second Prizes will be awarded, each consisting of a SanDisk Sansa™ 4GB e260 MP3 player and a six (6) month subscription to Rhapsody To Go. ARV: $420. each. Total value of all prizes in this Contest: $8,900.
- The Grand Prize Winner and Guest must have valid passports and other necessary travel documentation, if applicable, and must travel together. Travel must be completed before 7/15/07. Travel/accommodations restrictions may apply. Travel arrangements must be made at least 45 days in advance of departure date. Specific destinations, travel dates and arrangements are subject to availability. Actual retail value of prize depends on the city of departure and chosen destination, as well as time/date of travel. Any costs in excess of $5,000 are the winner's responsibility. If actual prize value is less than $5,000, winner will not be compensated in any way for the difference in value. The trip may not be combined with any other offer, and travel may not qualify for frequent flyer miles. All other expenses and costs not expressly listed above, including but not limited to income taxes, insurance, meals and tips, are solely the Winner's and/or the Guest's responsibility. If the Grand Prize is won by a person who is 18 but considered a minor in his/her state of residence, the prize will be awarded in the minor's behalf to his/her parent or legal guardian, who must sign all required winner documentation and accompany minor on trip as his/her Guest. If the winner is no longer considered a minor at the start of travel, he/she will no longer require a parent or legal guardian to accompany him/her.
- If a potential winner (a) cannot accept a prize as stated, (b) fails to use the Grand Prize within the specified time period, (c) if he/she is found to be ineligible, (d) if he/she does not comply with these Official Rules, or (e) if the prize notification is returned as undeliverable, the prize will be forfeited in its entirety and awarded to an alternate winner. All applicable income taxes on prizes are the sole responsibility of the winners. Prizes are non-transferable, with no cash redemption and no substitutions allowed except as provided herein. RealNetworks in its sole discretion, reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason. Limit one (1) prize per household. All other costs related to prize acceptance and use is the responsibility of the winners. If a prize winner is 18 but deemed a minor in his/her state of residence, the prize will be awarded to his/her parent or legal guardian on the minor's behalf. The awarding of prizes is further subject to the policies of the winners' employers; if such policies prohibit employees from accepting prizes, such prize will be forfeited and awarded to an alternate entrant based on the criteria stated herein. Sponsor in its sole discretion, reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable for any reason. Limit one (1) prize per household.
- All other costs related to prize acceptance and use are the responsibility of the winners. If a prize winner is 18 but deemed a minor in his/her state of residence, the prize will be awarded to his/her parent or legal guardian on the minor's behalf. The awarding of prizes is further subject to the policies of the winners' employers. If such policies prohibit employees from accepting prizes, such prize will be forfeited and awarded to an alternate entrant based on the criteria stated herein.
- Potential winners will be notified by Administrator via email and/or postal mail. Such winners may be required to sign and return an Affidavit of Eligibility and Liability/Publicity release (where permitted) within fourteen (14) days of receipt, or prize may be forfeited. The potential winner will be disqualified and will automatically forfeit all right, claim and interest in or to the prize for which his/her entry was selected, and Sponsor shall have no liability or responsibility to award such prize to said winner if: a) any required prize acceptance documents are not fully executed and received by Administrator at the designated address within the time period stated above; b) any notifications sent to the potential winners at the mail/email address provided by him/her is returned to Sponsor as undeliverable without a forwarding address or if potential Winner cannot be contacted for any reason, or (c) the potential winner fails to provide a proper mailing or email address.
- By participating in this Contest and accepting a prize, each winner (or his/her parent or legal guardian) agrees to release and hold harmless Sponsor, its affiliates, subsidiaries, advertising and promotional agencies and the officers, directors, employees and agents of each of the foregoing, from and against any and all liability, loss, harm, or damage, including, without limitation, property damages, personal injury and/or death, and cost or expense, including but not limited to all counsel fees and court costs, which may occur in connection with participation in the Contest, or the acceptance, possession or use/misuse of said prize, or participation in prize-related activities, including but not limited to travel related thereto. By accepting a prize, the winner (or his/her parents/guardians) also consent to the use of winner's names, voices, likenesses, and/or photographs by Sponsor, its affiliates and agents for advertising, publicity and trade purposes in commerce and in all media worldwide without limitation or additional compensation, except where prohibited by law.
- Sponsor reserves the right at its sole discretion to disqualify any contestant it finds to be tampering with or attempting to tamper with the entry process or the operation of the Contest, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person or contestant.
- This promotion shall be governed by, and construed in accordance with, the substantive laws of the State of Washington, excluding its rules on conflicts of law. Except where prohibited by law, as a condition of participating in this Contest, each entrant agrees that any and all disputes and causes of action arising out of or connected with this contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration in accordance with the Rules of Arbitration of the American Arbitration Association. The place of arbitration shall be Seattle, Washington. The language to be used in the arbitral proceeding shall be English.
Waiver: By participating in this promotion, participant waives all rights to claim punitive, incidental and consequential damages, attorneys’ fees or any damages other than actual out-of-pocket costs incurred to participate. - The winners' names will be published on http://webservices.rhapsody.com after the prizes are awarded.
